Divorce

Child Custody

In child custody matters, both the day-to-day needs and the long-term, “big picture,” requirements must be taken into account when considering the best interests of the child(ren).

In some cases, it is not practical or desirable for a child to spend equal time with each parent. Consequently, one parent will be awarded sole or primary custody and the other parent might be awarded parenting time. In other cases, joint custody is practical and both parents may be awarded equal time.

Child Support

The State of Nebraska provides guidelines outlining the process for determining child support. However, the Court reserves the right to decrease or increase child support dependent on various factors and circumstances.

Factors used to make a child support determination may include the following:

  • The gross income of both parents,
  • The number of children,
  • The cost of health insurance, and
  • Days spent in a calendar year with each parent

Paternity

Typically, paternity is voluntarily confirmed by both parties. Once confirmed, Nebraska courts expect attorneys and their clients to work together to determine a parenting plan that is in the best interests of the child(ren).
